Garden Court Chambers' Joint Head Sonali Naik KC and David Sellwood are advising the Skill Migrants Alliance on a potential legal challenge to Home Office proposals announced November 20, 2025, by Home Secretary Shabana Mahmood.
The proposals would extend ILR eligibility from five to ten years of UK residency and apply retrospectively to those already settled under the previous pathway. The consultation closed February 12, 2026.
SMA stated: "By securing the best legal counsel, we are sending a clear message to the Home Office: we are prepared, we are professional, and we are united."
Any legal action depends on the Home Office's final policy announcement. The legal team is instructed by Kingsley Napley. Coverage appeared in The National and the Electronic Immigration Network.
